LF <span class="equity">EQUITY</span> represented “Salut” hotel in court

On February 25, 2015 EQUITY law firm successfully represented “Salut” hotel in the Higher Administrative Court of Ukraine. The dispute arose due to unlawfully rendered tax assessment notice of STI in Pechersk district of Kyiv. The claim amounted to about 8 million UAH.

 

In 2011, as a result of a tax audit inspection the authority charged additional income tax for that amount. “Salut” filed a claim to the court to cancel the unlawful additional accruals. After the round of three court instances in the system of administrative courts of Ukraine, the case was forwarded back for a new trial in the first instance. In June 2014, the District Administrative Court of Kyiv upheld with its decision the claim of the hotel, but Kyiv Administrative Court of Appeal unlawfully overturned the decision of the previous instance.

EQUITY Lawyers managed to defend the legitimate rights of the hotel “Salut” in the Higher Administrative Court and prove erroneous conclusions of the court of appeal, violation of substantive law and legal practice mismatch. Thus, the Higher Administrative Court upheld the first instance decision left valid the lawful decision to recognize the actions of tax authorities as unlawful.
