<span class="equity">EQUITY</span> defended client’s right to construct Bilanivskyy Mining and Processing Plant

On December 3, 2015 law firm EQUITY successfully defended the interests of Bilanivskyy mining and processing plant in the Higher Administrative Court of Ukraine in a dispute under the claim of an individual to the Kremenchug district council. The plaintiff demanded to invalidate the approved Kremenchug district territory planning scheme, which provided for development and processing of Bilanivskyy deposits of ferruginous quartzite.

The dispute has lasted for 2 years, having passed through one circle of court processes. In October 2014 the Supreme Administrative Court of Ukraine by its decision sent the case back for reconsideration in the court of  the first instance. The new circle of court processes of three instances once again rejected the plaintiff’s claim.

Thus, the Supreme Administrative Court of Ukraine by its decision finalized the case, legitimizing the decision of Kremenchug district council, which approved the territory planning scheme of  Kremenchug district.
