Representatives of the wife of the murdered ASG employee filed the motion to obtain the victim status

On January 14, 2019, EQUITY attorneys filed the motion to involve Alina Khmeliuk, the wife of Vasyl Khmeliuk, the murdered employee of the Administration of State Guard, as the victim to the proceeding with Pechersk Police Division of the Main Department of the National Police in Kyiv City. From this moment on the Alina Khmeliuk will be represented pro bono (for free) by the team of EQUITY attorneys headed by partner – master of criminal law and procedure – Yaroslav P. Zeikan and company attorneys Valeriy Kirchev and Rodion Kokosh.

Short description of events:

- On January 2, 2019, at about 10:25 pm, boxer Petro Ocheretianyi being near house No 12, on Saperne Pole street in Kyiv, committed intentional murder of captain of the Administration of State Guard, a war veteran Vasyl Khmeliuk.

- On January 4, 2019, investigating judge of the Pechersk district court in Kyiv S.I. Smyk chose detention for 60 days (until March 3, 2019) as a restraint measure for the suspect with the possibility to deposit bail in the amount of UAH 600,000.

- On January 10, 2019, according to Kyiv Operatyvnyi Ocheretianyi deposited the bail.

- On January 14, 2019, right after the agreement on provision of legal assistance was made with the wife of the murdered, EQUITY attorneys filed the motion to involve the latter to the proceeding as the victim and to get familiar with the case materials.

“Under art. 55 and art. 56 of CPC of Ukraine there are no, even imaginary, grounds why Mrs Khmeliuk’s motion may be denied” – comments Alina Khmeliuk’s representative, attorney Yaroslav Zeikan.

As a reminder, obtaining the victim status will give Mrs Khmeliuk a number of rights under CPC of Ukraine in particular, to give evidence to the investigator, prosecutor, investigating judge, court; to contest decisions, acts and omissions of the investigator, prosecutor, investigating judge, court; to recover damages caused by a criminal offence; to get familiar with case materials; to participate in investigative (search) and other procedural actions; and other rights under art. 56 of CPC of Ukraine.
