<span class="equity">EQUITY</span> defended the client’s interests in a dispute with Anti-monopoly committee

On February 10, 2016 EQUITY lawyers successfully defended the interests of JSC “Zaporizhtransformator” in the Higher Economic Court of Ukraine in the dispute with the Antimonopoly Committee of Ukraine and Zaporizhzhya regional territorial office of the AMCU.

The subject matter of the judicial claim was the decision of the central and regional antimonoploy authorities on the abuse by the client of legislation on economic competition protection through actions that distort the results of the tenders. This decision actually banned the company to participate in tenders for the next 3 years.

To provide for full protection of the client’s interests, EQUITY lawyers started to appeal against the decisions of antimonopoly authorities in court and administrative proceedings, filing a corresponding claim to the Economic Court of Kyiv and subsequently filing an application for reconsideration of the decision by the authority itself. After the reconsideration the territorial authority revoked their decision on legislation breach that served to one of the grounds for the court of cassation to rule their decision in favor of JSC “Zaporizhtransformator”.
