EQUITY discussed the Law of Ukraine «On a Bona Fide Purchaser»

Andriy Ivaniv, Counsel at EQUITY and Chairman of the UAA Committee on Asset Protection and Investor Rights, and Maksym Saliy, Counsel at EQUITY, joined the professional discussion on the implementation of  Law No. 4292-IX  «On Amendments to the Civil Code of Ukraine on Strengthening the Protection of the Rights of a Good Faith Purchaser».

Ivaniv analyzed the legal basis for adopting the law, its key provisions, and its application mechanisms. He reviewed case law from the European Court of Human Rights, emphasizing the importance of incorporating a compensation mechanism into the law. He also outlined the European approach to protecting bona fide purchasers.

«This law is not only about protecting property rights, but also about building investor confidence. It is an important and correct step in strengthening the investment climate in Ukraine. That is why this discussion is extremely timely and constructive», Andriy Ivaniv emphasized.

Maksym Saliy focused on enforcing certain provisions of the law.

«Our common task — as attorneys, representatives of the judiciary, law enforcement, and civil society—is to ensure that the law works properly and is not distorted. Trust in the legal system as a whole depends on it».

The event was organized by Manifesto 42, an initiative that acts as an active platform for discussing legislation.
