Dmytro Polishchuk is a criminal defence attorney specialising in white-collar crime with a significant foreign element.
His experience encompasses both successful litigation and significant international results, including the recognition of extradition requests as inadmissible and the blocking of Interpol Red Notices.
Recent experience (projects):
- Extradition request declared inadmissible (Austria)
The National Anti-Corruption Bureau of Ukraine suspected an assistant to a Member of Parliament of being an accomplice in abuse of office. Ukraine requested her extradition from Austria. Dmytro coordinated the work of the Austrian legal team.
Outcome: the Austrian court declared the extradition request of the Prosecutor General’s Office inadmissible.
- Release of a businessman from custody (United Kingdom)
A businessman of Ukrainian origin was detained in London at Ukraine’s request on suspicion of a corruption offence. At the time of detention, the client had neither a UK legal team nor a defence strategy. Dmytro promptly engaged a British barrister and coordinated the defence.
Outcome: at the second hearing, after a month in custody, the Westminster Magistrates’ Court ordered the client’s release.
- INTERPOL: Blocking Red Notices
Dmytro has successful experience of communication with INTERPOL, resulting in the blocking of Red Notices.
- Success in a dispute against the Ministry of Justice of Ukraine (regarding the takeover of a criminal case from Poland)
Accusation against a client for providing an unlawful benefit. Cases regarding the same act were being conducted simultaneously in the courts of Ukraine and Poland. At Poland’s request for position on taking over the criminal proceeding, Ukraine failed to provide a complete response. Dmytro filed a lawsuit with the administrative court.
Outcome: the court ordered the Ministry of Justice to provide the necessary information to the Polish authorities.
- Success in a dispute over damages resulting from crime
A civil lawsuit was filed against a client, a top manager of a strategic enterprise, seeking compensation for material damage caused by an alleged crime. Dmytro represented the client in court and proved that the claims were unfounded.
Outcome: the court dismissed the lawsuit entirely.
