Long-awaited justice from EQUITY

On July 10, 2018, Bila Tserkva City Court of Kyiv Region draw a line under SIX-YEAR-LONG struggle for the just exemption from criminal liability of a person, EQUITY Client, in the most psychologically difficult category of crimes for defense counsels – in crimes against person's life and health.

So, after a long justification of the accused person position, numerous expert examinations and years of meticulous work of associates – during the last court hearing, when the case was considered in the first instance for the THIRD TIME, the prosecutor CHANGED the charge from Art. 121 Part 2 of the Criminal Code of Ukraine (intentional grave bodily injury that caused death of the victim) to Art. 125 Part 1 of the Criminal Code of Ukraine (intentional light bodily injury) and appealed to the court with a petition to exempt the Client from criminal liability due to expiry of periods of limitations.

In legal terms, this is the most just and long-awaited result of the long struggle for human rights and innocence, which was achieved by the team of EQUITY Partners – Oleksandr Lysak, Taras Poshyvaniuk and Viacheslav Krahlevych. As a result, the court upheld such appeal submitted by the prosecutor, exempted EQUITY Client from criminal liability and ceased criminal proceeding.
