ECHR ruled in favour of two EQUITY clients!
On 6 October, European Court of Human Rights found the defence's arguments well-founded and ruled in favour of two EQUITY clients. The cases concerned violations of Article 5 of the European Convention on Human Rights (right to liberty and security).
In both cases applicants complained that they had been detained unlawfully and there was no legal basis for arrest without a prior court decision. One client was detained by a NABU’s detective and other by the prosecutor's office investigator. Such actions are illegal under Article 5 § 1 of the Convention.
After detailed examination and analysis of the circumstances of the cases, the ECHR concluded that there had been a violation of Article 5 § 1 of the Convention in the State's actions.
