EQUITY successfully defended the interests of Belanivskiy Mining
May 12, 2015, the Avtozavodsk district court of Kremenchuk, Poltava region, ruled in favor of Belanivskiy mining and processing plant in a dispute upon the claim by an individual against the Kremenchuk district council.
The plaintiff in the dispute was seeking the remedy of canceling the approved Scheme of Planning the Territory of Kremenchuk district, which provides for the development and exploration of the Belanivskiy field of ferruginous quartzite deposits. Interests of the enterprise are represented by lawyers of EQUITY law firm.
The dispute has been in courts of all instances for more than 2 years. In October 2014, the Supreme Administrative Court of Ukraine remanded the case for further proceedings in the first instance. In turn, the Avtozavodsk district court of the city of Kremenchuk, Poltava region, had been considering the case since December 2014 and, ultimately, denied the plaintiff's prayers for relief. Thus, the court upheld the decision of the Kremenchuk district council regarding approval of the Scheme of Planning of the Territory of Kremenchuk District.
