EQUITY lawyers defended the interests of "AvtoKrAZ" in the Supreme Court of Ukraine

On March 25, 2015, EQUITY lawyers defended the interests of the PJSC "AvtoKrAZ" in the Supreme Court of Ukraine, in a dispute with a Russian company, Alfateks. The subject matter of the court dispute was the claim of the latter for the collection of funds in the amount of 7 million dollars.

Even in 2013, Alfateks filed a lawsuit with the court, demanding the recovery of said amount. Acting on the basis of a dubious assignment agreement, Alfateks claimed that the defendants failed to comply with the terms of a supply agreement. Interestingly, the PJSC "AvtoKrAZ" has never worked directly with the claimant. In fact, in the past car factory really delivered machines to the company with a similar name - "Production-commercial enterprise" Alfateks " Производительно-коммерческое предприятие «Альфатекс, but it was liquidated long ago, and " AvtoKrAZ " has no obligations to it.

Remember that in October 2014, the Supreme Court of Ukraine made a similar decision, taking the position of  the PJSC "AvtoKrAZ". In November 2014, a judge of the cassation instance, leaning on the recommendations of the SCU, decided on illegality of Alfateks’s claims.

The Russian company, in turn, filed an ungrounded application for review of the case in the SECU and obtained admission of the case to the Supreme Court of Ukraine, which repeatedly ruled in favor of "AvtoKrAZ".
