EQUITY Advocates on behalf of the People's Deputy of Ukraine

On May 21, 2019, Kyiv Court of Appeal sustained the appeal by the EQUITY Client and cancelled the investigative judge's decision on the refusal to open proceedings further to the claim by the People's Deputy of Ukraine Ihor Oleksandrovych Kotvytskyi against NABU detective's decision. The latter demanded from the people’s deputy to submit voice samples for expertise.

This criminal proceeding is being investigated by NABU with respect to PJSC HC “Energomerezha”.

Despite the fact that the law does not explicitly provide for the right to appeal against such a decision, EQUITY's lawyers were able to convince the court of appeal that the contested decision is in fact not provided for within the Criminal Procedure Code of Ukraine. Thus, in view of the current practices of the Grand Chamber of the Supreme Court, the court of appeal considered the claim the merits and sustained it.
