EQUITY Partner as Speaker at the School of Criminal Practice
The consecutive session of the School of Criminal Practice - First Instance Trial: from Investigation to Sentence – was held on June 11. EQUITY partner Taras Poshyvanyuk spoke to the students of the school on what motions are to be submitted at the initial stage of the court proceeding and emphasized the importance of the preparatory session, as it is at this very time that the attorney places the foundation for proper client defense in the future court session.
The partner reminded that in the course of pre-trial proceeding the court must verify availability of procedural grounds for a guilty plea or reconciliation agreement; check for availability of grounds to terminate the proceeding; validate compliance with the requirements of criminal procedural law of the indictment, claim on application of compulsory measures of educational influence or application of compulsory measures of medical influence; check compliance with the jurisdiction of criminal proceedings; prepare the conditions for a successful trial.
