EQUITY lawyers contributed to the drafting of a law to protect businesses

The relevant committee of the Verkhovna Rada supported draft law No. 12439, which amends the Code of Criminal Procedure and establishes new safeguards against excessive pressure on businesses.
EQUITY was directly involved in preparing this document. Andrii Ivaniv and Taras Poshivanyuk worked on developing the key provisions that were supported by the parliamentary committee today.
The changes awaiting businesses include:
- clear time limits for the seizure of funds (up to four months, with the possibility of extension only by a reasoned court decision);
- appeals against decisions to legalize «urgent» searches;
- the obligation to record everything seized during a search in the protocol is another change. Otherwise, the evidence is inadmissible;
- restrictions on law enforcement agencies resubmitting the same motions without new grounds;
- clearer deadlines have been established for considering motions for temporary access to property and documents.
These changes will restore predictability to business, make the process more transparent, and significantly reduce the risk of abuse.
