EQUITY lawyers obtained a final decision for the client in the case of compensation for moral damages

EQUITY lawyers obtained a final decision for the client in the case of compensation for moral damages in the Civil Cassation Court of the Supreme Court.

The plaintiff claimed compensation for damages caused by the illegal actions of the pre-trial investigation, the prosecution and the court. The cause of action was the cancellation of the verdict of the Darnytskyi District Court of Kyiv City by the Kyiv Court of Appeal and the closure of the criminal proceedings due to insufficient evidence to prove the plaintiff's guilt.

The defendants opposed the claim, arguing that the plaintiff had not suffered any non-pecuniary damage. However, the court decided to award UAH 344,000 in moral damages to the State of Ukraine, which the plaintiff will pay to support the Ukrainian Armed Forces.
