EQUITY participated as a General Partner in the 11th Restructuring and Insolvency Forum.

 


 

Oleg Malinevskyi, Managing Partner at EQUITY, opened the Forum by chairing the first session, ‘Institutional Development’.

"The insolvency sector is one that offers businesses a second chance, a chance at recovery. And in my view, the main risk that poses a certain threat is the factor of uncertainty. We must determine where we are heading, on what principles, and towards what goals, as we navigate these difficult times."

 

 

Yaroslav Labatyuk, an counsel at EQUITY, joined the discussion on trends in law enforcement with a presentation entitled "Grounds for initiating, suspending and terminating proceedings:

an analysis of case law".

“Formally, the only unconditional ground for refusal remains full repayment of the debt prior to the preparatory hearing. At the same time, practice requires a more balanced and broad interpretation of the rules: to protect solvent businesses and balance the interests of creditors.”

 

 

Ilona Mylostyva, Senior Associate at EQUITY, addressed the issue of “The criminalisation of bankruptcy: where is the line between commercial risk and crime?” during the session on stakeholder liability.

“Not every bankruptcy is a crime. The decisive factors are motive, intent and the existence of a proven link between the actions of officials and the consequences for the company.”
