EQUITY for the second time acted as an expert partner of the II Legal Anti-Corruption Forum
On 4 December, Yurydychna Praktyka held the II Legal Anti-Corruption Forum in expert partnership with EQUITY for the second time.
«The issues of investigative jurisdiction and justiciability should be more strictly regulated in the Criminal Procedure Code. It is necessary that the prosecutor, the investigator and the defence clearly understand the rules of the game and no one can violate them» - Vyacheslav Krahlevych, Partner at EQUITY.
Vyacheslav Krahlevych spoke at II Anti-Corruption Forum on «Current Issues of investigative jurisdiction and justiciability in Anti-Corruption Criminal Proceedings: Practical Notes» during the premiere session of the II Anti-Corruption Forum.
The partner analysed the legislative changes made at the beginning of the full-scale invasion, shared his experience in anti-corruption cases and outlined the issues.
«Attorneys understand what the consequences can be if a criminal case is investigated by the wrong authority,» the Partner said, stressing that the attorney general's attitude to resolving jurisdictional disputes, perhaps to please public opinion, should not be a priority: «There is a rule of law and let's follow it.»
Taras Poshyvanyuk, Partner at EQUITY, moderated the discussion «Problems of Anti-Corruption Proceedings» at the ІІ Legal Аnti-Сorruption Forum.
Together with representatives of the bar, judges of the Supreme Court and representatives of the prosecutor's office, discussed:
- Legal positions of the Supreme Court: qualification of crimes under Articles 368 and 369 of the Criminal Code of Ukraine, powers of officials in corruption offences.
- Application of plea agreements: expanding the possibilities of their use in corruption cases, the impact of legislative changes on the plea process, in particular on the confiscation of property.
- Procedural deadlines for pre-trial investigation: assessment of judicial control over their observance and the need to change the practice.
- The burden on the judicial system: the effectiveness of the plea bargaining institution as a way to reduce resource costs.
Discussion of such issues is extremely important for ensuring effective fight against corruption in Ukraine. The panelists agreed that it is necessary to improve legislation in the field of anti-corruption justice.
