Partner and Counsel at EQUITY joined the roundtable from the UAA
The Ukrainian Advocates' Association held a roundtable discussion with the participation of partner at EQUITY Taras Poshyvanyuk and counsel at EQUITY Andrii Ivaniv: Draft Law No. 12439 on improving guarantees of protection of business entities during criminal proceedings.
- Taras Poshyvanyuk: «This draft law is aimed at protecting business entities and their interests. As a members of the working group involved in the development of the draft law, our main focus was on the main problematic factors faced by business. These include searches, seizure of property and blocking of business operations. We proposed legal mechanisms to help overcome these difficulties and protect business rights».
- Andrii Ivaniv highlighted the problematic aspects of this issue: «The problem remains the lack of a clear regulation the conditions for legalisation of property seized during searches conducted without the investigating judge's decision. We have set a timeframe within which the legal status of the seized property will be clarified. This will provide a safeguard for the immediate return of the property».
More generally, the document proposes amendments to the Criminal Procedure Code aimed at improving the protection of the rights of entrepreneurs during criminal proceedings. The bill has already passed its first reading in the Verkhovna Rada and is now awaiting revision. The panelists discussed in detail the key provisions and their impact on law enforcement practice.
