EQUITY represents Igor Mazepa, the founder and CEO of Concorde Capital, in criminal proceedings regarding land plots in Kyiv region.
The course of the case:
- On January 18, 2024, Igor Mazepa was detained by the State Bureau of Investigation without any explanation of the grounds for such detention or provision of any procedural documents that could be the legal basis for the detention.
- On January 19, at about 7:30 am, Ihor Mazepa was served with a notice of suspicion stating that as a result of the alleged creation and leadership of a criminal organization and privatization of state property, Ihor Mazepa allegedly caused damage to the state in the amount of UAH 7 million.
- At the same time, in the motion for a preventive measure, the prosecution requested a preventive measure in the form of detention with an alternative bail of UAH 700 million, which is 100 times higher than the estimate of the damage caused by law enforcement agencies.
In violation of the principle of adversarial proceedings, the hearing on the application for a preventive measure was scheduled for January 19, 2024 at 12:00 pm.
In less than 5 hours, EQUITY attorneys formed the legal position of the defense and prepared the relevant procedural documents.
As a result of many hours of consideration, the court decided to halve the bail.
We note that the trial was held with a gross violation of procedural rules. A striking example of this is the disregard and failure to consider the personal obligations of the persons who were ready to act as guarantors for Igor Mazepa.
Currently, the defense is preparing an appeal against the court decision of the court of first instance.
