EQUITY Lawyers Have Ex-Chief of the Registration Service of the Main Department of Justice in Kyiv Acquitted!

The client of the company was accused of accepting an improper advantage under Part 3, Article 368 of the Criminal Code of Ukraine. During the debate, the prosecution asked the Court to award the client a 6-year imprisonment with forfeiture of property and deprivation of the right to occupy certain positions, while the defense asked the court to acquit the client in connection with missing elements of crime in his actions. Following the speech of the EQUITY defense lawyers, the prosecutor filed a motion for submission of new evidence, and changed the charge from accepting improper advantage (Part 3, Article 368) to influencing decision-making (Part 2, Article 369-2).

Qualification changed, during the following courts debate, the prosecution asked to award a 5-year imprisonment, while the defense asked to acquit their client. But, on October 12, after a thorough examination of the materials of the case, the Holosiivskyi District Court of the City of Kyiv acquitted the client due to the lack of evidence under Paragraph 3, Part 1, Article 373 of the Criminal Procedure Code of Ukraine.

The fight is underway, and defense lawyers have plenty of work ahead. However, getting acquittals, with the overall statistics of 1%, proves that we have chosen the right way.
