EQUITY represents Odesa Mayor Gennadiy Trukhanov in the ECHR
EQUITY team led by partners Alexander Lysak and Taras Poshyvanyuk successfully represented the Mayor of Odesa city Genadiy Trukhanov in the ECHR.
On December 1, 2022, the ECHR, in its decision, found a violation of paragraph 1 of Article 5 of the European Convention on Human Rights and stated the fact of the client's illegal detention.
In February 2018, the Mayor of Odesa city Genadiy Trukhanov was detained by NABU detectives at Boryspil airport. During the detention, attorneys informed the detectives about the unlawful nature of their actions, because the day before the NABU detectives were informed about Trukhanov's return to Ukraine after a business trip. The next day, judge imposed on the mayor a pre-trial restraint not related to detention. At the same time, the court decision on the basis of the consideration of the request for the application of a preventive measure stated the fact of the legality of his detention by NABU detectives. Thus, having used all means of national protection, our team appealed to the ECHR to establish a violation of paragraph 1. of Article 5 of the Convention on Unlawful Detention.
The work on this case lasted more than 4 years, but the result justified all the efforts.
