EQUITY was a Prime Sponsor of the 2nd Ukrainian Arbitration Forum

“Development of the system of alternative dispute resolution is one of the priorities of the judicial reform in Ukraine. For this reason, it is important to raise issues which enhance pro-arbitration of Ukraine”. This statement of Oleg Malinevskyi, an EQUITY partner, introduced Session I of Arbitration Forum II.  

What does the Alternative Reality of Ukraine look like? 

With colleagues from Ukraine, Great Britain and France participating, the speakers considered mechanisms to settle disputes of businesses with the state, main tendencies of the international arbitration, current features of the Ukrainian pro-arbitration and instruments of the pre-trial dispute resolution under the Anglo-Saxon Law.  

Winding up the discussion, the Chief Editor of the Yurydychna Praktyka, Rustam Kolesnyk, presented a study of quality of arbitration services in Ukraine. The complete version is expected in 2022.

During Session III of the event, speakers were discussing relevant issues of the investment arbitration. The panel discussion was moderated by Oksana Varakina, an EQUITY counsel.

The experts focused on issues such as jurisdiction of emergency arbitration, enforcement of arbitration awards against the state, discussion of new investment claims against Ukraine, standards to protect investments as well as the category of ‘public order’ in the practice of national courts.
