Criminal Cassation Court closed criminal proceeding on the case of EQUITY’s client.

The client of the company was accused of committing a crime specified by Part 2, Article 364 of the Criminal Code of Ukraine (abuse of power or office). 

On October 18, the Shevchenkyvskyi District Court of the City of Kyiv passed a ruling dismissing the proceeding on the ground of Para. 10 of Part 1 of Article 284 of the Criminal Procedure Code of Ukraine, since the court received an indictment beyond the terms of pre-trial investigation. Seizure of the client's property has been cancelled.

According to the Ruling of the Kyiv Court of Appeal from 07/12/2021 the appeal of the prosecutor was left without satisfaction.

Criminal Cassation Court found no grounds for the satisfaction of the cassation appeal and passed a ruling to close the criminal proceeding (27/07/22).

Attorneys proved that the court received an indictment beyond the terms of pre-trial investigation.

The prosecutor of the Office of the Prosecutor General did not support the appeal of the prosecutor of the Kyiv Regional Prosecutor's Office.

According to the defence position, the prosecutor's cassation appeal was of a formal nature.
