EQUITY became the General Partner of the 10th  International Litigation Forum

The issue of judicial reform is of particular importance during martial law. It is a major part of the European integration process for Ukraine. That’s why the litigation during martial law is the first topic in a two-day discussion at the 10th Litigation Forum.

At the beginning of the discussion EQUITY partner Oleg Malinevskiy said «The judicial system of Ukraine has received too many challenges in recent years - inconsistent reforms, Covid-19 and terrible full-scale war. As a result it has not just stood up to these challenges, but also has been given the chance to develop in a large European legal family.»

Key opinions of the experts:

  • Priorities in the implementation of judicial reform include: further European integration, introduction of full-fledged electronic proceedings, proper material provision of courts, ensuring proper execution of judgments, revision and facilitation of procedural codes;
  • Establishment of military courts is a reasonable step to restore justice during russian war against Ukraine;
  • Funding of the judicial system remains an urgent problem, which has deepened due to the military bias in budgetary policy and the reduction of court fee revenues. The problem is particularly acute for court staff.
  • The judicial community was extremely consolidated during the war, making it possible to decide quickly on measures of ensuring the sustainability of the judicial branch of power;

The second day of the 10th Litigation Forum was as intense and filled with professional discussions as the first one. EQUITY partner Vyacheslav Krahlevych took part in 5th session «Defence in Criminal Proceedings: Wartime Challenges». 

During his speech Vyacheslav focused on the role of Ukrainian courts in the process of recovering damages caused by the russian federation. 

In particular, the partner analysed three Draft Laws registered in the Verkhovna Rada of Ukraine which aim to elaborate the process of legal proceedings against the russian federation and its associated persons. Vyacheslav also shared positive and negative court judgments regarding recovery of damages from russia.
