EQUITY Counsel Contributes to Opening New Legal High School for Corporate Lawyers
Monday is the time for great achievements and new knowledge. For this reason, the very first lectures started today at the Legal High School for corporate lawyers!
Out of the main reasons of abuse he differentiated attempts to change the court composition, impartiality of the court, postponement of hearings with the aim to gain time/evidence, etc.
The lecturer accentuated that the boundary between the constructive and destructive elements in this context is extremely subtle, with the distinctive feature of the procedural subversions being their substantiation. The main ‘classical’ procedural abuses are filing several claims, recusals, filing repeated unreasonable motions, counterclaims, untimely answers and objections.
Andriy Ivaniv stressed that the normative guideline for the court is one of the main principles of the commercial procedure, namely the principle of inadmissibility to abuse one’s procedural rights. The court, being unbiased and impartial, has to prevent abuse of their rights by trial participants and take measures to perform their obligations.
