Employe Reservation rules: Key Consideration for businesses
The full-scale war has compelled businesses to seek ways to retain key personnel. One such instrument is the reservation of employees of critically important enterprises. However, in practice, this procedure has proven to be complex and dynamic: the regulatory framework is constantly evolving, and employment at a critical enterprise does not automatically guarantee reservation.
In an article for the newspaper Yuridychna Praktyka, EQUITY Senior Associate Hlib Tymofiiuk and EQUITY Junior Associate Bohdan Prachun explain:
- the legal requirements that employees and employers must fulfil to obtain reservation;
- the significance of having data registered in the Oberig database and the implications of the note «Data not found»;
- the main obstacles that may arise (absence from military registration, untimely updates of personal information being listed as wanted, or issues with formalizing employment relations);
- how employers and employees can address these challenges;
- the courts’ approach to cases involving th unlawful inclusion of wanted status in the Oberig registry.
