Ukraine against russia in International Court of Justice
Key points:
- International Court of Justice, by its decision on provisional measures of March 16, 2023, decided that the russian federation should stop military operations it began on February 24, 2022 in Ukraine, pending a final decision on the case.
- According to Article 41 of the Statute of the ICJ, orders on provisional measures are binding and create international legal obligations for any party to which the provisional measures are addressed.
- Ukraine's position in this dispute will concern not only the further initiation of disputes by Ukraine on compensation for damage caused by the russian federation. The decision in this case may also serve as a precedent to prevent further implementation of russia's aggressive policy, which once again justifies its military aggression by alleged "self-defense" by manipulating Article 51 of the UN Charter.
- One of Ukraine's claims in this case is to oblige the russian federation to fully compensate for all damage caused by Russia as a result of any actions taken on the basis of the russian federation's false claim of genocide.
