The <span class="equity">EQUITY</span> Partner participated in LHS DH "Arbitration Manager in the New Bankruptcy Procedure"!

On November 19, Oleg Malinevskiy, an EQUITY partner, took part in the discussion of issues related to the arbitration manager in bankruptcy procedure, in Legal High School Discussion Hub.

The Hub participants discussed a number of important issues regarding new powers of arbitration managers, the search for accounts and property of the debtor, procedural and technical issues, as well as discussed the issues of bankruptcy of individuals and ways to resolve them, the association of arbitration managers in a self-regulatory organization, additional (triple) control, as well as analyzed the international experience on this issue.

Oleg Malinevskiy, an EQUITY partner, does not believe that the role of the arbitration manager is increasing, on the contrary, the manager is bocoming increasingly dependent on the creditor. Also, the partner said that the electronic system is neglected by a single decision of the creditors' committees about the possibility to remove the arbitration manager at any time. From the figure whose loyalty was constantly struggled for, the arbitration manager turns into the communicator of the will of the creditors.

Oleg Malinevskiy positively evaluated a single self-regulatory organization, but  sated  that "the details were questionable".  How will such an organization be created? These issues will be becoming more and more significant. When an organization by  its decisions influences participation in the profession - such an organization them draws a greater attention, he stressed.
