EQUITY represents Interests of RwS Bank
EQUITY provides procedural support to move the insolvent Omega-Bank PJSC out of the market by establishing a transitional Perehidnyi RwS Bank PJSC invested by Ukrainian Business Group LLC.
In 2016 EQUITY successfully protected interests of Perehidnyi RwS Bank PJSC in Kyiv Commercial Court of Appeal in its dispute with Lybid Hotel PJSC. The subject matter of the dispute concerned the certificate of transfer of rights under the loan agreement in the amount of 12 million US dollars concluded between Lybid Hotel PJSC and Omega-Bank PJSC.
In 2019 the Sixth Administrative Court of Appeal ruled for RwS Bank PJSC to deem changes to the Gas Transmission Code unlawful. The subject matter concerned a regulation of the National Energy and Utilities Regulatory Commission (NEURC) introducing changes to the Gas Transmission Code. The aforementioned regulation specified discriminatory conditions for the most of Ukrainian banks to provide financial security of natural gas transmission services to clients. Such provisions violated rights and lawful interests of a large number of banks in Ukraine as well as rights of entities in the natural gas market of Ukraine.
